Facilitator: KwiGO operates the platform and facilitates connections but is not responsible for individual transactions between Users and Merchants.
Handling Fee: A flat fee of RWF 500 applies to each successful redemption, deducted automatically from the discount value.
Dispute Support: If you have an issue with an Offer, we will actively help facilitate a resolution between you and the Merchant.
Age Limit: You must be at least 16 years of age to register and use the KwiGO platform.
Account Security: You are responsible for keeping your account credentials safe and confidential.
Good Faith: The platform operates on good faith. Deceptive, fraudulent, or abusive actions are strictly prohibited.
1. Introduction and Acceptance of Terms
KwiGO exists to create value for both Users and Merchants—connecting people to great Offers and giving Merchants' businesses a trusted platform to reach their customers.
We are a company incorporated under the laws of the Republic of Rwanda. We operate a digital marketplace through which independent Merchants list Offers and registered Users discover and redeem those Offers.
KwiGO is not responsible for any individual transaction between the User and the Merchant, but we take our role as a facilitator seriously, meaning we are accountable to both sides of the marketplace.
For the User, this means providing a safe, reliable platform where your interests are respected and where we will actively support you if necessary. For the Merchant, it means fair access to a growing user base, clear rules of engagement, and a platform built on trust.
By downloading, registering for, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions of Service. If you do not agree, please discontinue use of the Platform.
2. Definitions and Terminology
The following definitions apply throughout these Terms and Conditions of Service:
means a registered User profile created on the Platform.
means the laws and regulations of the Republic of Rwanda related to this business.
means any day other than a Saturday, Sunday, or official public holiday in the Republic of Rwanda.
means any independent business, brand, or service provider that lists an Offer on the Platform. Any reference to "Merchant" includes the plural "Merchants" and vice versa.
means any discount (including permanent discount), deal, promotion, or value-added service made available by the Merchant to the KwiGO app. Any reference to "Offer" includes the plural "Offers" and vice versa.
refers to KwiGO and the KwiGO mobile application, website, and all related digital tools and services operated by KwiGO. The terms "KwiGO" and "Platform" are used interchangeably and carry the same meaning.
means the act of a User claiming an Offer through in-app verification mechanisms, including QR codes, promotional codes, one-time passwords (OTP), Merchant-side manual entry, or other methods KwiGO may designate.
means a flat fee of five hundred Rwandan francs (RWF 500) charged to the User upon each successful Redemption, in consideration of transaction processing and Platform operations, as further described in clause 7.3.
means any individual who registers for and uses the Platform. Any reference to "User" includes the plural "Users" and vice versa.
3. The KwiGO Platform
KwiGO is a facilitator. Here is what that means in practice for both Users and Merchants:
3.1 What KwiGO Does
KwiGO maintains the technical Platform, operates Redemption verification systems, and enforces these Terms and Conditions of Service.
Beyond the technical, KwiGO actively facilitates communication between Users and Merchants—including where the User needs support resolving a problem with an Offer.
While KwiGO cannot compel a Merchant to act in any particular way, we will make reasonable efforts to assist the User in reaching a satisfactory outcome.
3.2 What KwiGO Does Not Do
KwiGO does not manufacture, supply, or sell any goods or services listed by the Merchant.
KwiGO does not act as a legal agent for any Merchant; each Merchant operates independently and is responsible for its own products and services.
KwiGO's review of the Merchant before listing is a high-level assessment, not an endorsement.
4. Eligibility and Account Registration
4.1 Eligibility
To use the Platform, the User must be at least 16 years of age and have the legal capacity to enter into a binding contract under Applicable Law.
4.2 Account Responsibilities
Each User is responsible for keeping their login credentials confidential and for all activity that takes place through their Account.
If you believe your Account has been accessed without your authorization, please contact us immediately so we can act promptly to protect you.
4.3 Account Suspension and Termination
KwiGO will only suspend or terminate an Account where there are genuine grounds to do so. Immediate termination without prior notice may occur in the following circumstances:
- Suspected fraudulent, deceptive, or abusive activity.
- Suspected money laundering or provision of false identity documentation.
- Abusive behavior toward User, Merchant, or KwiGO personnel.
- Where an Account poses an immediate risk to Platform security.
Where termination is not for the above reasons, KwiGO will provide 5 Business Days' prior written notice. Within that period, the User may request a summary of his/her transaction history, provided that request does not conflict with legal or fraud prevention obligations.
5. User Responsibilities and Prohibited Conduct
The KwiGO Community works because Users, Merchants, and KwiGO all engage in good faith. The following rules exist to protect everyone on the Platform.
5.1 User's Engagement
The User is encouraged to engage with the Platform for lawful, personal purposes and to interact with the Merchant honestly and respectfully.
5.2 Prohibited Conduct
To protect the integrity of the Platform and the interests of all participants, the following conduct is strictly prohibited:
- Attempting to redeem an Offer fraudulently.
- Using automated tools, robots, or scripts to interact with the Platform.
- Using the Platform to solicit Merchants for Offers outside the KwiGO Platform.
- Attempting to reverse-engineer any KwiGO verification system.
6. Merchant Responsibilities and KwiGO's Role
KwiGO sets clear expectations for Merchants so that the User can engage with confidence. Where the Merchants fall short, KwiGO will not simply step aside.
6.1 The Merchant Responsibilities
Each Merchant is an independent operator and is solely responsible for every aspect of the Offer it publishes—including the accuracy, quality, and delivery of its Offers, where such delivery is managed by the Merchant directly. KwiGO's high-level review of the Merchant before listing is not a guarantee of that Merchant's standards.
If the User or the Merchant experiences a problem with an Offer, KwiGO encourages them to raise a dispute through the Platform within the time frame stated in section 8.1. KwiGO will facilitate communication between the User and the Merchant, using reasonable efforts to support them in reaching a resolution.
6.2 Limitation of KwiGO's Liability for Merchant Conduct
Because KwiGO does not control Merchant operations, and to the fullest extent permitted by Applicable Law, KwiGO's liability does not extend to:
- Defective, unsafe, or mislabeled goods provided by the Merchant.
- Personal injury or financial loss caused by the Merchant.
- The loss, damage, delay, or non-delivery of physical goods managed by the Merchant or their third-party logistics and delivery provider.
6.3 High-Value and Specialist Products
For electronics, appliances, and bulky goods, the Merchant is solely responsible for packing, transport (made by the Merchant or a third party), and insurance. KwiGO is not responsible for manufacturer warranties or after-sales support, which remain the Merchant's obligation.
7. Offers, Redemptions, Availability, and Handling Fee
7.1 Redemption Process
KwiGO's verification systems are designed to make the Redemption experience as smooth and reliable as possible. A Redemption is valid when the Offer is active and the User meets all Merchant-specified eligibility conditions at the time of Redemption.
7.2 Offer Availability and Withdrawal
To protect the User who may be planning to redeem an Offer, the Merchant is required to provide 48 hours' notice before withdrawing a live Offer. Exceptions apply only in cases where withdrawal is required by Applicable Law.
7.3 Platform Handling Fee
Handling Fee: A flat Handling Fee of five hundred Rwandan francs (RWF 500) shall apply to each successful Redemption processed through the Platform. This fee is charged to the User in consideration of transaction processing and Platform operations.
Where a Merchant has applied a discount to an Offer, the Handling Fee shall be automatically deducted from the total discount value credited to the User at the time of Redemption, such that the net discount received by the User shall be reduced accordingly.
Where the value of the applicable discount is less than RWF 500, the Handling Fee shall be limited to an amount equal to that discount, and shall not exceed it.
The Handling Fee is non-refundable save where a Redemption is reversed as a result of a verified Platform error attributable to KwiGO.
8. Dispute Facilitation
In case of disagreement between the User and the Merchant, KwiGO will not leave you to figure it out alone. We are here to help.
8.1 How We Support and Solve a Dispute
KwiGO is committed to supporting the User and the Merchant when an Offer does not deliver what was expected.
While KwiGO is not an arbitrator and cannot compel the Merchant to issue a refund or take any specific action, we will actively facilitate communication between the User and the Merchant—including escalating concerns where appropriate—and will use our reasonable efforts to help reach a fair outcome.
8.2 How to Raise a Dispute
To give KwiGO the best opportunity to assist, disputes should be submitted through the Platform within 48 hours of the relevant transaction. This window exists so that KwiGO can engage the Merchant promptly, while the transaction details are current and verifiable. We encourage the User to reach out to KwiGO as soon as possible if an issue arises.
For electronics and appliances, KwiGO's dispute facilitation ends at the point of delivery. Acceptance of delivery by the User shall be deemed confirmation that the product was received in functional working conditions. Any subsequent defect, fault, or damage shall be treated as a warranty matter between the User and the Merchant, and KwiGO provides no warranty or after-sales support of any kind.
9. Intellectual Property
All intellectual property rights in the Platform are owned by KwiGO.
By submitting reviews or feedback on the Platform, the User grants KwiGO a perpetual, royalty-free license to use, display, and reproduce that content across any medium or channel KwiGO deems appropriate, including but not limited to the Platform, app store listings on Google Play and the Apple App Store, and KwiGO's social media channels.
The User warrants that any content submitted is truthful and not defamatory and agrees to indemnify KwiGO against any defamation claims brought by the Merchant in response to the User's review.
10. Privacy and Data
KwiGO takes the privacy and security of User and Merchant data seriously.
Personal data is processed in accordance with KwiGO's Privacy Policy, which sets out in full how we collect, use, and protect your information. The Privacy Policy is available at www.kwigo.app/privacy.
11. Disclaimers and Limitation of Liability
KwiGO works continuously to ensure that the Platform and the Offers listed on it are accurate, available, and of value to the User. However, the Platform is provided "as is", and KwiGO cannot guarantee that all information will be free from error at all times.
To the fullest extent permitted by Applicable Law, KwiGO's liability for incidental or consequential damages arising from use of the Platform is excluded. This limitation reflects KwiGO's role as a platform facilitator and does not affect any rights the User may have directly against the Merchant or vice-versa.
12. Amendments to These Terms and Conditions of Service
KwiGO may update these Terms and Conditions of Service at any time. Where a change is material, such as an adjustment to liability limits or the dispute process, KwiGO will notify the User and the Merchant at the time the change takes effect.
Minor corrections and clarifications may be made without notice. KwiGO is committed to communicating changes clearly so that the User and the Merchant can make informed decisions about continued use of the Platform.
13. Termination
The User may close his/her Account at any time. KwiGO respects that choice and will process closure promptly. Termination does not affect any rights or obligations that have accrued prior to the date of closure.
For the Merchant, termination will follow the contract between KwiGO and the Merchant.
14. Indemnification
The User and the Merchant agree to indemnify and hold harmless KwiGO from any claims, losses, or damages arising directly from the User's or Merchant's breach of these Terms and Conditions of Service or from fraudulent acts committed through their Account.
15. Governing Law and Dispute Resolution
These Terms and Conditions of Service are governed by the Applicable Law of the Republic of Rwanda.
Any dispute arising out of or relating to these Terms or the Services shall be submitted to the exclusive jurisdiction of the competent courts of Rwanda.
16. General Provisions
- Entire Agreement: These Terms and Conditions of Service constitute the entire agreement between the User, the Merchant, and KwiGO in relation to the Platform.
- Severability: If any provision is found to be unenforceable, it shall be severed without affecting the validity or enforceability of the remaining provisions.
- No Third-Party Rights: These Terms and Conditions of Service are strictly between the User, the Merchant, and KwiGO. No other person shall have rights to enforce any part of these Terms and Conditions of Service.
- Survival: Sections 6, 9, 11, 14, and 15 shall survive termination of these Terms and Conditions of Service.
By downloading, registering for, or using the KwiGO platforms, the User and the merchant certify that each has read and understood these Terms and Conditions of Service and consents to be bound by them as described herein.
